Summary: The National Council of Farmer Cooperatives (NCFC) argues that the proposed regulations create a conflict with the statute by potentially requiring taxpayers to use emissions rate tables that include indirect land use change (ILUC) penalties. They contend that this could undervalue U.S. agricultural feedstocks and fail to meet Congressional intent to encourage domestic clean fuel production.
