The proposed rule rescinds protections for LGBTQ+ families and individuals implemented in the 2012 and 2016 Equal Access Rules, subjecting these families to discrimination and exclusion. Most concerning, the rule mandates that CPD-funded shelters exclude transgender people from facilities that match their gender identity, and allows those providers to conduct invasive inquiries into their physiology to confirm their HUD-defined “sex.”
We urge that this proposed rule be withdrawn in its entirety and existing regulations protecting LGBTQ+ families in HUD-funded shelters and housing remain in effect
