Comment Submitted by American Civil Liberties Union (ACLU)

Summary: The American Civil Liberties Union (ACLU) opposes the proposed revisions to HUD's Equal Access Rule, arguing that the changes would authorize discrimination against transgender and gender nonconforming individuals. They contend that the Proposed Rule would result in significant safety risks, increased administrative burdens for service providers, and violations of the Fair Housing Act and the Violence Against Women Reauthorization Act.
The American Civil Liberties Union (ACLU) submits this comment in opposition to the above-docketed notice concerning the proposed revisions to the U.S. Department of Housing and Urban Development’s existing Equal Access Rule and related protections. The current Equal Access Rule is crucial to the ongoing fight for equal access to housing and shelter in the United States, particularly for LGBTQIA+ people. The ACLU strongly opposes the Proposed Rule and urges HUD to preserve the existing rule and related protections against discrimination in HUD-funded programs. Please see attached for the ACLU's comment.
