Summary: The American Bar Association (ABA) opposes the Proposed Rule, arguing that it would reverse existing protections for transgender and nonbinary individuals by allowing providers to deny access to sex-segregated facilities based on sex assigned at birth. The ABA contends that the rule would increase barriers to housing, violate federal nondiscrimination laws (including VAWA and the ADA), and heighten the risk of homelessness and violence for vulnerable populations.
