I am writing to formally report Fountain Square Towing (https://fountainsquaretowing.com) , a private towing company operating in Bowling Green, Kentucky(327 West 6th Avenue, Bowling Green, KY 42101), for engaging in predatory billing practices, imposing illegal junk fees, and actively violating a municipal consumer protection ordinance.
Active Ordinance Violations:
The City of Bowling Green recently amended Chapter XV - Business & General Regulations (Ordinance No. BG2026-3) to cap towing fees and eliminate predatory charges. Despite losing a federal lawsuit attempting to block this ordinance (Case No. 1:2026cv00031, dismissed March 13, 2026), Fountain Square Towing continues to publicly advertise illegal fees on their website:
Legal maximum impound fee: $125. They advertise: $175 — an illegal overcharge of $50
After-hours gate fee: eliminated entirely by ordinance. They still advertise: $25
$10 credit card surcharge per card, which likely violates Visa and Mastercard merchant processing agreements
This company fought consumer protection in federal court, lost, and is openly defying the ordinance anyway.
Consumers towed in Bowling Green have no ability to shop around or refuse service. They are a captive audience being charged illegal rates with no recourse at the moment of payment.
I urge the FTC to investigate Fountain Square Towing for active violation of local consumer protection ordinances and predatory junk fee practices.
