Summary: OMS Compliance Services, a C/TPA, supports the 510(k) exemption for DOT collection devices to facilitate oral fluid collections. June 18, 2026 OMS Compliance Services supports the exemption of 510(k) for DOT collection devices, so as to allow for Oral Fluid collections. As a C/TPA we have the unique ability to view this from many angles and are excited to offer this less invasive procedure to our clients. We have completed our training, and devices are on hand. Standing Orders for our clients have even been updated twice since oral fluid was “approved” (but not yet able to be utilized). The greatest asset for our business will be that while all Oral Fluid collections are directly observed, they will not require a same-sex collector. We usually have women in the office and have to call our male collector off the road from their onsite collections for direct observations. In our area, the majority of Follow-Up candidates are male. This puts us, and those clients, at a disadvantage and increases the cost of labor. We also have a large number of seasonal employees in our tourist heavy area. Those who are working in the sun throughout the day in the summer season are often dehydrated donors, leading to a high number of shy bladders. Oral Fluid collections would reduce not only our time (labor costs), but the employers’ labor costs associated with the collection. No more “shy bladder” charges or being without their team member for up to 3 hours of their workday. While I cannot speak for other ecologies, we know our region very well. It pains us for our clients to incur costs otherwise avoidable. Any process that drives up our operating costs, in turn drives up their pricing. Those striving for compliance are at a disadvantage as they compete with the many parties who disregard compliance requirements altogether. Lowering overall compliance costs would go a long way to mitigate the costs they bear until effective compliance enforcement has caught up with these circumstances.
