Through this, the EPA weakens critical protections for coal ash disposal, including exemptions for dewatering structures and allowing site-specific considerations that could lead to less stringent cleanup standards. The removal of the environmental demonstration requirement for beneficial use of CCR is reckless and opens the door for widespread contamination. Reopening the comment period for the federal CCR permit program is a delaying tactic. This rule prioritizes industry profits over the safety of our communities and ecosystems, and it must be stopped.
