Summary: The National Mining Association (NMA) supports the EPA's proposed rule to remove regulatory barriers to the beneficial use of coal combustion residuals (CCR), rescind CCR management unit (CCRMU) requirements, and provide alternative closure pathways. They argue that the current CCRMU requirements are based on flawed risk assessments and that the proposed changes will provide necessary clarity and flexibility for the mining and energy industries.
The National Mining Association (“NMA”) appreciates the opportunity to submit comments on the U.S. Environmental Protection Agency’s (“EPA” or the “Agency”) proposed rule, “Hazardous and Solid Waste Management System: Disposal of Coal Combustion Residuals from Electric Utilities; Legacy/CCRMU Amendments,” 91 Fed. Reg. 18,968 (April 13, 2026).
