by MMC=IPCC -- Multiple More Coal = Initiative Prevention CO2 Catastrophe -- (UN-ICJ) === to the Honorable Administrator of the Environment Protection Agency, to the Honorable Head of OTAQ, Office of Transportation and Air Quality, and to all those mentioned in Sec.5 sub (d) of the U.S. presidential executive order 14154 === testimony by MMC=IPCC to; EPA-HQ-OAR-2025-3297-0001, proposed rule, “ Tier 4 Criteria Pollutant Standards, Part 1: Phase-In Schedule for Light-Duty and Medium-Duty Vehicles”, EPA. May 18th 2026 === The matter is also of Transatlantic importance. It also burdens imported European cars with the high technical demands but still disadvantages the great Ford and GM companies. More stringent USA regulations encourage even more insaint regulations in the EU. === The overstringent regulations make piston engines such expensive that it forces towards too expensive battery electric vehicles, BEVs. Such push for too expensive BEVs is illegal. Tier 2 bin 10 has to be reintroduced for almost all USA. The public will choose BEVs if they are produced for half the present price. That is possible after a decade or more. A shift to BEVs is possible if there is sufficient affordable electricity available. That is possible with a large number of new flexible coal fired power plants, on USA coal. When competitative windpower units become available, they can complement and save coal. Such a shift of mobility to the affordable abundant available coal complemented with affordable windpower, is desirable. === Fossile fuels (coal) can NOT constitute the main cause of the ongoing steep large rise of the CO2-concentration in the troposphere. Probably pesticides (for “bio”fuels) do. Please see attachment {1}, {2} and {3}. Exactly USA coal is the affordable possible USA solution against CO2, by fertilization of the Northern Atlantic ocean, please see attachment {3}. === Tier 4 regulations would be a marvelous masterpiece of work if it was not such expensive for the vehicle users, by; higher purchase prices, higher maintenance costs and shorter economical lifetimes of the vehicles because of much higher engine prices and wear. Compared to tier 2 bin 10 in more than 99% of the area of the USA, tier 4 does not convey any significant improvement for public health. Only in Los Angelos, San Fransisco etc. it could convey a tiny improvement for public health, but not measurable because other causes impair public health multiple more, see attachment {4} please. However those cities could apply reasonable levies for disencouragement of the use of vehicles with more emissions than Tier 3 and in future Tier 4. There is no valid reason for burdening all USA. === Conclusion: There is neither a valid real factual reason for Tier 4 in all USA and therefore neither a valid legal reason for such Tier 4. Apologies to all those enthausiast for absolute clean air. You have already achieved very clean air. Please switch and support the rescue of mankind against at least seven really detrimental developments. === There is no real factual reason for limitations on CO2 emissions (att. {1}, {2}, {3}). Therefore limitations on CO2-emissions are violations against global law (att. {2}, {3}); the advisory opinion 187 of the highest UN-court on Juli 23 of 2025. The suspicion is that decarbonizationfundamentalism is a destructive tool for the destruction of the Global North / white people (section 9, att. {4}). === Forcing the expensive Tier 4 on all USA while it is useless for 99% of the area of the USA, is a grave violation against the complex of the Founding Principles of the USA, the duty to serve the Constitutional Posterity, the Constitution and the Amendmends. (att. {3} > p.16, > p.63 and att. {4} section 9) === A complete ban of all fossile fuels will cost every household in the USA in average thirty thousand dollars annually, is not affordable within five decades. Decarbonization and transfer to BEVs must be slowed down so that the transfers can be done when they have been made affordable. Develop first instead of wasting too much money when it is still too much expensive.
