Do CO2 or Helium wells need to be addressed as part of this rule? If a helium well falls under "Gas well" definition in 3179.1; can methane associated with the gas stream for that well then be flared or disposed of? It would appear not based on 3179.41(d)..unless 3179.41 (b) (12) provides the necessary exception to dispose of gas well gas? There are helium wells in Montana that contain minor amounts of methane that operators are requesting to vent, flare, or dispose of downhole. It would be nice if that could be addressed even if in the preamble.
