This is something that should have always been the case. In nearly every other legal proceeding from trusts, to inheritances, to even debt in some states, the spouse is able to jointly own property without special accommodations. The fact that surviving spouses have been left to contend with significant ATF issues if their significant other passes is another reason why this should have been addressed much sooner. Like the elimination of the engraving rule for Form 1 submissions this is a commonsense approach that is long overdue.
