The National Firearms Act Trade and Collectors Association (NFATCA) strongly supports this Notice of Proposed Rulemaking (NPRM). The proposed rule appropriately recognizes that individuals who lawfully possess firearms and are traveling between lawful locations should not incur criminal liability solely because unforeseen circumstances necessitate a temporary interruption or delay in their journey. The current regulatory framework creates the potential for otherwise law-abiding citizens to be subjected to criminal penalties based not on any unlawful conduct or threat to public safety, but on circumstances beyond their control. Such an outcome is inconsistent with fundamental principles of fairness and sound administrative policy. A regulatory scheme that transforms lawful conduct into a criminal offense solely because of an unavoidable delay is arbitrary, capricious, and unsupported by any corresponding public safety benefit. By clarifying that temporary interruptions or delays incidental to lawful travel do not negate the protections afforded under the law, this proposed rule provides necessary certainty to lawful firearm owners while preserving the government's legitimate public safety interests. NFATCA therefore urges the Bureau to adopt the proposed rule as written.
