Summary: The commenter supports the proposed rule but argues that it needs to be more comprehensive. First I'd like to commend the ATF for finally thinking about the pitfalls of travelers and the problems that they run into while traveling. I wholeheartedly agree with this proposed rule. However I don't think it goes far enough.
1. The proposed rule is unclear whether it supersedes state law in certain circumstances. Example, I live in NH which is a constitutional carry state. If I want to fly out of Boston Logan airport to let's say Miami. Can I bring a 15 round magazine with me since Massachusetts state law says 10 round magazine max. Will I be arrested at the airport. This needs to clearer in the proposed rule.
2. I am concerned with overnight stays in states you don't have permits in. If the gun is to stay in a locked container in states you don't have a permit, this means you lose your constitutional right to self defense in these states. Something I think the Supreme court addressed in Bruin and the right to self defense. So I believe there needs to be a provision that allows use of the firearm if the traveler "believes" they are in a situation where they may sustain "death or serious bodily injury". I believe we have a right to self defense anywhere we have the legal right to be. I think this needs to be addressed even if some state are butt hurt with this provision, the constitutional right of US citizens to self protection I believe supersedes it.
