Summary: The commenter supports the removal of the DOJ-added definitions but suggests adding a "safe harbor" provision for private sales. They argue that private sales conducted by a Federal Firearms Licensee (FFL) with a background check should exempt the seller from being classified as "engaged in the business."
While I support the removal of the DOJ added definitions, I would encourage added language to provide an easily verifiable safe harbor for law abiding gun owners. While I don’t support a requirement to require background checks on private sales, I would support language that specifies that any private sale completed by an FFL with a background check exempts the seller from the “engaged in the business” rule.
