Summary: The commenter supports the ATF's effort to clarify the ambiguous definition of an unlawful user of or addicted to a controlled substance. They suggest that the ATF may want to delay the final rule until pending Supreme Court cases and the marijuana reclassification are fully finalized to ensure legal consistency.
Writing in support of RIN 1140-AB03. This is a good faith effort on the part of the ATF to handle a statute that is ambiguous and vague at best. I am glad to see ATF state they may have to readdress this situation after SCOTUS resolves cases currently pending before the Court on this very matter. The recent re-classification of marijuana by the Federal Government will also play a part in teh final rule.
If the Hemani case and marijuana reclassifcation isn't FULLY finalized by the time this proposal is due to be published as final, ATF may want to consider delaying it so the final rule is fully in accordance with the drug schedule and SCOTUS's latest ruling.
