Summary: An individual argues that the definition of an "unlawful user" should be updated to exempt people with valid medical marijuana cards. They contend that these individuals are using the substance lawfully for medical purposes and that the current definition is unnecessarily adversarial to patients.
In order to be consistent with, "persons who are “current user[s]” of a controlled substance “in a manner other than as prescribed by a licensed physician.” anyone who has a medical marijuana card should be exempt. The reality is they are using it lawfully, the law abiding character being made clear, with the purity of their substance being trustworthy, and the data showing that frankly alcohol is far more concerning. It is excessively adverserial then to complicate the unalienable rights of a person who is taking their medication. It should then naturally follow that in order to not contradict the law itself it is obvious that this kind of person is not an unlawful user and therefore this update should catch up to the present. Where is the justice in taking rights from those who use medicine for say, cancer, epilepsy, glaucoma, ptsd, etc? It is an interpretation the agency actually has the power to make and results in a more coherent and just system in the first place. This should be a cut and dry and obvious and an easy decision to make.
