Summary: The commenter supports the proposed rule because they believe the criminalization of lawful gift purchases between family members is a regulatory overreach. They argue that a gift purchase between non-prohibited persons should not be considered a straw purchase.
I support this proposed rule. The criminalization of lawful gift purchases between family members represents a serious regulatory overreach that has put innocent gun owners at legal risk. For example, if I purchased a rifle as a Christmas gift for my son and was uncertain whether this exposed me to prosecution under the straw purchase prohibition. Where neither party is a prohibited person, a gift purchase is not a straw purchase. I urge ATF to finalize this rule. RIN 1140-AA78.
