Summary: Dr. John E. Latz, Jr. supports the proposed rule to clarify that lawful gift purchases between family members do not constitute straw purchases. He argues that the current regulations represent regulatory overreach that puts innocent gun owners at legal risk.
I strongly support this proposed rule. The criminalization of lawful gift purchases between family members represents a serious regulatory overreach that has put innocent gun owners at legal risk. [Add your own example — e.g., "I purchased a rifle as a birthday gift for my adult son and was uncertain whether this exposed me to prosecution under the straw purchase prohibition" or "My father bought me my first firearm as a coming-of-age gift — a tradition in our family for generations. This should never be classified as a straw purchase."] Where neither party is a prohibited person, a gift purchase is not a straw purchase. I urge ATF to finalize this rule. RIN 1140-AA78. Thank you.
