The term "straw purchase" refers to buying a firearm on behalf of someone who is prohibited from owning one — a genuine crime. But ATF's overbroad application of this definition has swept in entirely lawful transactions: a parent buying a rifle as a gift for an adult child, a husband purchasing a handgun for his wife's birthday, a grandparent passing down a family heirloom. None of these involve a prohibited person. None are straw purchases under any reasonable reading of the statute.
This proposed rule redefines "straw purchase" to align with the actual statutory prohibition and Supreme Court precedent, clarifying that gift purchases and purchases for non-prohibited family members are lawful transactions. GRNC supports this as a restoration of common sense.
