Summary: The commenter opposes the proposed rule, arguing that it is unconstitutional, violates privacy, and creates an impossible situation for transgender individuals seeking to exercise their Second Amendment rights. They also contend that the rule would complicate the ATF's enforcement mission by creating contradictory information.
This proposed rule change is unconstitutional and places a specific class of people in an impossible catch-22, preventing them from exercising their Second Amendment rights as law abiding citizens. It serves no purpose other than to unconstitutionally restrict law-abiding transgender people from purchasing firearms. No gun shop or dealer has the means to verify the "biological sex" of purchasers, and doing so would be a massive privacy violation for all Americans. Furthermore, it complicates the ATF's mission of enforcement by creating contradictory information, forcing individuals to submit paperwork that contradicts their ID documents which were lawfully issued in accordance with the laws of the state they reside in which will result in unfair denials.
