Summary: The commenter opposes the proposed rule to select biological sex on ATF forms, arguing that it is unconstitutional and based on identity politics. They contend that the right to bear arms belongs to all "PEOPLE" regardless of gender.
ATF’s proposed rule is patently unconstitutional. More importantly, ATF must know it is unconstitutional but has chosen to proceed forwards anyway.
The 2nd amendment speaks precisely to, “ the right of the PEOPLE to keep and bear Arms.” And the Supreme Court of the United States has ruled time and again that the PEOPLE’s right to keep and bear arms is fundamental to each person. Nowhere in the Constitution or law are gender distinctions made as it relates to that right. That’s because regardless of gender, gun buyers and owners are PEOPLE.
In reality, ATF is engaging in identity politics under a thinly veiled pretext. The ATF has a choice. Its hands are not tied - even by what it claims to be conformity with executive orders. Choose to follow the constitution.
In the meantime, do something that actually mitigates gun violence and doesn’t unconstitutionally hassle people.
