Summary: The commenter opposes the proposed rule, arguing that requiring a binary sex selection on ATF forms would discriminate against and unconstitutionally restrict the Second Amendment rights of intersex and transgender individuals.
This proposition would seriously impact the second amendment rights of many intersex gun owners and buyers, since their sex does not fit the binary of male or female. It could also harm transgender people's ability to purchase and keep firearms due to their born sex potentially not matching with the sex listed on their government ID (if they previously had it changed). If this proposed rule were to go into effect, many people, both intersex and transgender, would be unconstitutionally stripped of their legal right to bear arms. Please reconsider this rule change on the basis that it is discriminatory and goes directly against the second amendment.
