Electronic notices, electronic forms, auto-population, digital attachments, and a longer period of NICS validity can improve compliance without burdening the exercise of a constitutional right. The final rule should minimize the amount of personal information collected, avoid adding questions not expressly required by statute, and ensure that digital records do not become a national registry or a centralized searchable database of lawful gun owners. ATF should adopt the least burdensome process consistent with the statute and provide clear safe harbors for immaterial clerical mistakes.
